CBD is not a controlled substance under the Misuse of Drugs Act so long as it has been produced from an EU-approved, industrial hemp strain. CBD producers should therefore follow these basic principles:
- When purchasing CBD Oils and other CBD products you should ensure that they are derived from EU-approved, industrial hemp strains such as Cannabis Sativa, although there are some 60+ different strains of industrial hemp that can be legally grown for the production of a diverse range of CBD products in the UK.
- Marketing material must comply with UK regulations – Retailers can’t make any medical claim, (although there is enough anecdotal evidence online to suggest that taking CBD as a supplement for good health is a worthy option to explore).
- It is legal to purchase CBD products in the UK as long as they contain less than 0.2% THC or none at all. All CBD products, whether they are CBD tinctures, balms, capsules or vaping (e-liquids) all must contain less than 0.2% tetrahydrocannabinol (THC).
